LEGAL NOTICE AND GENERAL CONDITIONS OF USE OF THE WEBSITE

The ownership of this website, www.muscaricollection.es,(hereinafter, Website) corresponds to MUSCARI COLLECTION, S.L., a limited company, registered in the Mercantile Registry of Madrid, Volume [...], Folio [...], Section [...], Sheet of the Companies Book [...], with Tax Identification Number B-09742925 and registered office at C/ Prof. Waksman, 11, 28036 Madrid (hereinafter "MUSCARI").

II. GENERAL TERMS AND CONDITIONS OF USE
The object of the conditions: The Website
The purpose of these General Conditions of Use (hereinafter, Conditions) is to regulate access to and use of the Website. To the effects of the present Conditions it will be understood as Web Site: the external appearance of the interfaces of screen, so much of static form as of dynamic form, that is to say, the tree of navigation; and all the elements integrated so much in the interfaces of screen as in the tree of navigation (in forward, Contents) and all those services or resources in line that in its case it offers to the Users (in forward, Services).
Muscari reserves the faculty to modify, at any time, and without previous warning, the presentation and configuration of the Web site and of the Contents and Services that in him could be incorporated. The User recognizes and accepts that at any time Muscari can interrupt, deactivate and/or cancel any of these elements that are integrated in the Web site or the access to the same ones.
The access to the Web site by the User has free character and, as a general rule, it is free without the User having to provide a consideration to be able to enjoy it, except for the cost of connection through the telecommunications network supplied by the access provider that the User has contracted.
The use of any of the Contents or Services of the Web Site may be made by prior subscription or registration of the User.
The user
The access, navigation and use of the Website, as well as the spaces enabled for interaction between the Users, and the User and Muscari, such as comments and/or blogging spaces, confers the condition of User, and therefore the User accepts, from the moment he/she starts browsing the Website, all the Conditions established herein, as well as their subsequent modifications, without prejudice to the application of the corresponding legal regulations of obligatory compliance as the case may be. Given the relevance of the above, the User is recommended to read them every time he/she visits the Web Site.
Muscari's Web Site provides a great diversity of information, services and data. The User assumes responsibility for the correct use of the Website. This responsibility shall extend to:
- An use of the information, Contents and/or Services and data offered by Muscari without being contrary to the arranged thing by the present Conditions, the Law, the moral or the public order, or that in any other way can suppose injury of the rights of third or of the same operation of the Web site.
- The veracity and legality of the information provided by the User in the forms extended by Muscari for the access to certain Contents or Services offered by the Web site. In any case, the User will immediately notify Muscari about any fact that allows the improper use of the information registered in such forms, such as, but not only, the theft, loss, or unauthorized access to identifiers and / or passwords, in order to proceed to its immediate cancellation.
Muscari reserves the right to remove all those comments and contributions that violate the law, the respect for the dignity of the person, that are discriminatory, xenophobic, racist, pornographic, spamming, that attempt against youth or childhood, order or public safety or that, in its opinion, will not be appropriate for publication.
In any case, Muscari will not be responsible for the opinions expressed by the Users through comments or other blogging or participation tools that may exist.
The mere access to this Web Site does not imply any type of commercial relationship between Muscari and the User.
The User declares to be of legal age and to have sufficient legal capacity to be bound by the present Conditions. Therefore, this Muscari Web Site is not directed to minors. Muscari declines any responsibility for non-compliance with this requirement.
The Web Site is primarily directed to Users residing in Spain. Muscari does not assure that the Web Site complies with the laws of other countries, either totally or partially. If the User resides or has his domicile in another place and decides to access and/or navigate in the Web Site he will do it under his own responsibility, he will have to make sure that such access and navigation fulfills the local legislation that is applicable to him, Muscari not assuming any responsibility that can be derived from this access.

Muscari will in no case review or control the content of other websites, nor does it approve, examine or make its own the products and services, contents, files and any other material existing in the aforementioned linked sites.
Muscari does not assume any responsibility for the damages and prejudices that could take place by the access, use, quality or legality of the contents, communications, opinions, products and services of the Web sites not managed by Muscari and that are linked in this Web site.

V. INTELLECTUAL AND INDUSTRIAL PROPERTY
Muscari itself or as an assignee, owns all intellectual and industrial property rights of the Website, as well as the elements contained therein (including but not limited to images, sound, audio, video, software or texts, trademarks or logos, color combinations, structure and design, selection of materials used, computer programs necessary for its operation, access and use, etc.). They will be, therefore, works protected as intellectual property by the Spanish legal system, being applicable to them both the Spanish and Community regulations in this field, as well as the international treaties related to the matter and subscribed by Spain.

Pursuant to the provisions of the Intellectual Property Law, the reproduction, distribution and public communication, including its mode of making available, of all or part of the contents of this website, for commercial purposes, in any medium and by any technical means, without the authorization of Muscari, are expressly prohibited.
The User undertakes to respect the intellectual and industrial property rights of Muscari. VI. LEGAL ACTIONS, APPLICABLE LAW AND JURISDICTION
Muscari reserves the right to file the civil or criminal actions that it considers necessary for the improper use of the Web Site and Contents, or for the breach of the present Conditions.
The relationship between the User and Muscari will be governed by the regulations in force and applicable in the Spanish territory. If any controversy arises in relation to the interpretation and/or the application of these Conditions the parts will submit their conflicts to the ordinary jurisdiction submitting to the judges and courts that correspond according to right.
